A Motion
To enact into law The Delegate Voting Act
Introduced to the General Assembly of the Union of Democratic States on the 22nd of July 2020

RECOGNIZING only passing mention is made of the World Assembly Delegate position in the Constitution;
NOTING this mention is limited to Article 6.6 and establishes the Delegate as a position appointed by the Chancellors;
ACKNOWLEDGING the Chancellors themselves are not elected officials;
BELIEVING that in a proud democracy as little power as possible should be derived from non elected positions so as to maintain the importance of democracy to the region;
ASSERTING then that the Delegate should be limited as much as possible to a mere figurehead position especially in the usage of their onsite World Assembly powers,
THE FOLLOWING IS ENACTED AS LAW:
Section I: Definitions
1. “The Delegate” is the World Assembly Delegate of the Union of Democratic States as recognized as the region’s most endorsed member on NationStates and formally appointed by the Chancellery per 6.6 of the Constitution.
2. “The President” is the democratically elected head of the Union of Democratic States Executive Branch as certified by the Chancellery in their duty as election officers.
3. The “General Assembly voting page” is the NationStates page found at www.nationstates.net/page=ga.
4. The “Security Council voting page” is the NationStates page found at www.nationstates.net/page=sc.
Section II: World Assembly Voting Procedures
1. The Delegate must vote on all World Assembly resolutions at the explicit direction of the President.
2. This explicit direction may take any form that the President desires so long as the Delegate is notified of it in the first 72 hours of the resolution at vote.
3. If the President does not provide their voting direction within the first 72 hours of the resolution at vote, the Delegate shall cast their vote according to the majority will of the Union of Democratic States voting WA members as indicated on the General Assembly or Security Council voting pages.
4. If the President does not provide their voting direction within the first 72 hours of the resolution at vote and there is no majority among the Union’s voting WA members the Delegate shall abstain from voting on the resolution.
Section III: Extenuating Circumstances
1. If there is no sitting President, whether due to elections or unforeseen circumstances, the Delegate shall follow the voting procedure outlined in Section 2.3 and 2.4 after 72 hours has elapsed from the resolution voting opening.
2. If the Delegate is the sitting President the procedures outlined in Section 2 need not be followed.
Section IV: Rogue Delegate Voting
1. If the Delegate improperly abstains or votes contrary to the voting position established by the processes of this act as outlined in Sections 2 and 3, the Delegate may be guilty of Malfeasance in Office as defined by the Criminal Code Act.
2. Section 4.1 does not apply if the Delegate is unable to vote due to a formal leave of absence.
