Now, this is highly hypocritical of me, but I have not had the time, desire or knowledge to draft a new constitution, but I have have thought of how I would like a new constitution to look:-
Executive:
A Premier-Presidential system, not unlike Germany's Chancellor and President system or Italy's one.
Presidency - Head of State, Commander-in-Chief, veto power, formally appoints PM and cabinet members and justices, head of foreign policy, executive orders.
To do the foreign policy one, the President shall also hold the Delegacy ex officio.
President's veto can be overwritten with 66% support
Commander-in-chief, but does need cabinet support for military operations
As appointer and dismisser he will, always, need support of [insert thing here]
Deputy VP and Deputy Delegate, two different jobs.
PRESIDENT CAN NOT BE ANYTHING ELSE BUT A PRESIDENT (unless they work for a ministry)
Treaties and declarations of war need Legislative support
Elected via popular ballot
Premier - Call it Prime Minister, Chancellor, idrc but essentially works as our current PM minus powers given to the President in this system and the fact they must come from the lower house in the legislature but will be voted in by popular vote. When legislature elections occur, PM candidates will need to be accepted on 2 fronts, one as a member of the lower house and as PM.
CAN NOT BE PRESIDING OFFICER OF LOWER HOUSE
Cabinet - same as current essentially, however executive orders are enough to create new ministries. And, yes, there will be a Foreign Ministry with a Minister to assist the PM. Deputy PM may be an ex officio role for another minister
Legislature:
Bicameral;
Upper House: a revising Chamber, probably called either the Senate or Council of State, 1 Member appointed by President, one by the CJ, 3 elected.
Has a veto power that can be overruled by another vote with a majority. Designed to look over bills/motions passed by the Lower House and redesign/fix/adapt them to be better.
All changes by the Upper House have to be agreed upon by the lower one, if not agreed upon by the lower house the amendment is tossed out and (if the bill wins support again in the lower house) it goes to be signed by the President.
No Presiding Officer
Lower House: basically the Assembly + the activity of the Senate and powers as current. can VoNC everything (VoNC's needed to supported via referendum 2). On a VoNC on a Lower House Legislator said person cant vote, has a Presiding Officer.
Judiciary:
Only real changes from our current system are a nomination system: Justice candidates need support from 3-5 people to run and Justices can not be in any elected position, nor inherit any elected position.
